Intellectual Property Policy

Sharkteelix provides an online platform where users can design and sell their own T-shirts and other merchandise.

We strictly prohibit users from creating or selling products that violate the intellectual property rights of others, including but not limited to copyrights, trademarks, and related rights.

If you believe that a user on Sharkteelix has infringed on your intellectual property rights, please follow the procedure outlined below.

A. Reporting Intellectual Property Infringement
Sharkteelix will take prompt action in good faith to remove or block any content (“Content”) that appears to violate third-party intellectual property rights upon receiving a valid infringement notice.

Accounts of repeat offenders will be permanently terminated. If you believe your copyrighted work or other intellectual property is being infringed upon, please submit an infringement notice to our Designated Agent with the following details:

  1. Identification of the Infringed Work: Provide details of the copyrighted or protected work, including any applicable registration numbers.
  2. Identification of the Infringing Content: Describe the content that infringes on your intellectual property and provide its location on the Sharkteelix platform, ensuring sufficient detail for verification.
  3. Contact Information: Include your full name, mailing address, phone number, and email.
  4. Statement Under Penalty of Perjury: Confirm that the use of the intellectual property is unauthorized and that the information provided is accurate.
  5. Signature: Provide an electronic or physical signature of the authorized individual acting on behalf of the rights holder.

B. Actions Taken Upon Receiving a Valid Infringement Notice
Sharkteelix will remove or disable access to the allegedly infringing content.

The user responsible for the content will be notified.

Repeat offenders will have the infringing content permanently removed and their account access revoked.

C. Submitting a Counter-Notice
If a user believes that their removed or disabled content was not infringing or that they have the legal right to use it, they may submit a counter-notice to the Designated Agent containing:

  1. Identification of the Removed or Disabled Content: A description of the content’s previous location on the Sharkteelix platform.
  2. Statement Under Penalty of Perjury: A declaration that the content was removed in error or misidentified.
  3. Contact Information: Full name, mailing address, phone number, and email.
  4. Jurisdiction Consent: Agreement to the jurisdiction of the Federal Court for the judicial district where the user resides, or if outside the USA, where Sharkteelix operates.
  5. Signature: Electronic or physical signature.

If a counter-notice is submitted, Sharkteelix may forward it to the original complainant, notifying them that the removed content may be reinstated within 10-14 business days, unless legal action is taken by the rights holder.
